Notice of Hearing
A public hearing will be held at 9:00 a.m. December 1, 2023, in the conference room of the Kansas Development Finance Authority (the “Authority”), 534 S. Kansas Ave., Suite 800, Topeka, Kansas, on the proposal for the Authority to issue its tax-exempt Revenue Bonds (the “Bonds”) in a principal amount not to exceed $13,000,000. The Bonds will be Qualified 501(c)(3) Bonds as defined in Section 145 of the Internal Revenue Code of 1986, as amended, and will be issued pursuant to K.S.A. 74-8901 et seq. (the “Act”) to finance the construction, renovation, furnishing and equipping of new stadium facilities and related improvements located on the main campus of Wichita State University (the “University”) at the location of the former Cessna Stadium at or about 1845 E. 21st Street North (generally, bounded by E. 21st Street North to the north, Charles Koch Arena to the west, Perimeter Road to the south, and N. Yale Avenue to the east) in the City of Wichita, Kansas (the “Project”), the principal users of which will be the University and Wichita State University Intercollegiate Athletic Association, Inc., a Kansas not-for-profit corporation.
The Bonds, when issued, will be a limited obligation of the Authority, payable solely from the portion of the proceeds of the Special Tax Levy (as defined herein) distributed to UMB Bank, N.A., as trustee (the “Trustee”), pursuant to a Tax Distribution Agreement among the Authority, the Trustee, Sedgwick County, Kansas (the “County”) and the Board of Trustees of Wichita State University. The “Special Tax Levy” means the one and one-half mill special ad valorem tax levy adopted and levied on all taxable, tangible property in the County, including the City of Wichita, Kansas, levied by the County for the benefit of the University.
The Bonds will not constitute a general obligation or indebtedness of the State of Kansas or any political subdivision thereof, nor will the Bonds constitute an indebtedness for which the faith and credit and taxing powers of the State of Kansas are pledged. The Bonds shall not, directly, indirectly or contingently, obligate the State or any political subdivision thereof (other than the County with respect to the Special Tax Levy) to levy any form of taxation or make any appropriation for their payment.

At the hearing, all individuals who appear will be given an opportunity to express their views for or against the proposal to issue Bonds to finance the Project, and all written comments previously filed with the Authority at its offices at 534 S. Kansas Ave., Suite 800, Topeka, KS 66603 will be considered. Additional information regarding the Project may be obtained by contacting the Authority at the address of its offices listed above.
