Notice of the Right to Request a Hearing

Pursuant to K.S.A. 77-440, the Kansas Department of Revenue, Division of Alcoholic Beverage Control (“ABC”) submitted a report to the Joint Committee on Administrative Rules and Regulations summarizing ABC’s review of its administrative regulations and identifying regulations that are not necessary for the implementation and administration of state law. Pursuant to K.S.A. 77-426(d), the Department of Revenue proposes to revoke three of the regulations identified in that report by filing a notice of revocation with the Secretary of State. Pursuant to K.S.A. 77-426(d)(2)(A), the department will schedule a public hearing on the proposed notice of revocation only upon the written request of a member of the public. This Notice of the Right to Request a Hearing serves as at least 30 days’ notice of the right to make that written request.

The following regulations are proposed for revocation because they duplicate existing statute:

K.A.R. 14-7-10. Beer distributors must provide designated geographic territory.

K.A.R. 14-7-11. Change or modification of geographic territory.

K.A.R. 14-7-12. Beer distributor selling outside his designated geographic territory.
