Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications

In accordance with Kansas Administrative Regulations 28-16-57a through 63, 28-18-1 through 17, 28-18a-1 through 31 and 33, 28-16-150 through 154, 28-46-7, and the authority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been prepared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.

The proposed actions concerning the draft documents are based on staff review, applying the appropriate standards, regulations, and effluent limitations of the state of Kansas and the Environmental Protection Agency. The final action will result in a Federal National Pollutant Discharge Elimination System Authorization and/or a Kansas Water Pollution Control permit being issued, subject to certain conditions, revocation, and reissuance of the designated permit or termination of the designated permit.

The proposed permit contains limits for Biochemical Oxygen Demand, Total Suspended Solids, and Ammonia; as well as monitoring for pH, E. coli, Total Phosphorus, Nitrates + Nitrites, Total Kjeldahl Nitrogen, Total Nitrogen, Chloride, and Selenium. This NPDES discharging lagoon wastewater treatment facility has been reviewed for eligibility for the MDV for ammonia and has been determined to be eligible. Eligibility was determined through analysis of the facility’s highest attainable criteria (HAC) for ammonia and an Economic Eligibility Determination (EED) that assessed the impact of the cost of a new mechanical facility to the community’s rate payers. The ammonia effluent limit was determined on July 13, 2022, by calculating the 99th percentile ammonia value from the Permittee has received a Consent Order Case Docket No. 19-E-01 BOW from KDHE. Permittee shall implement the requirements of the Consent Order and any amendments or replacements thereto facility’s discharge monitoring reports resulting in an ammonia limit of 7.4 mg/L for this facility.

The proposed action is to reissue an existing State/NPDES permit for an existing facility. This facility manufactures greeting cards, decorative ribbons, and stickers. Operations include cutting, stamping, and folding of paper stock, printing, extrusion, plastic molding, and packaging. Domestic wastes and cafeteria wastes are processed through an oil / water separator and directed to the city sanitary sewer. In addition, wastewater from washing process areas and compressor condensate are also processed through an oil/water separator and are discharged to city sanitary sewer. Oils from oil water separators and other sources are shipped off-site for disposal. The facility uses boiler for heat and steam. The boiler blowdown is discharged to the Publicly Owned Treatment Works (POTW). The facility uses cooling tower for air conditioning during summer months. Daily blowdown of the cooling towers no longer occurs. When the cooling towers are operating, about 1,000 gallons per day of non-contact cooling tower blowdown and additional stormwater runoff are discharged from each outfall 001A and 002A to the Kansas River via an unnamed tributary. The proposed permit contains generic language to protect the waters of the state.

The proposed action is to reissue an existing State/NPDES permit for an existing facility. This is a surface water treatment plant that is designed to treat 6 MGD, utilizing lime softening processes. Raw water will be treated using pre-sedimentation basins, circular clarifiers, solids contact clarifiers, gravity sand filters and a chlorine contact basin. Chlorine will be used for primary disinfection before the water is sent to the clear well. Water is then pumped to storage, prior to distribution. Sludge from the pre-sedimentation basins (20,000 gpd), lime softening wastes from clarifiers (50,000 gpd), filter to waste (25,000 gpd), filter backwash (65,000 gpd) and floor drains from the HSP building (2 gpd) will be pumped to a two-cell lagoon system for treatment. Online monitoring and laboratory wastewater (6,900 gpd) and miscellaneous floor drains from the shop area (170 gpd) and domestic wastes will be sent to the Fredonia sanitary sewer. Outfall 001A consists of the discharge from either of the two lagoons, which will discharge to Salt Creek, via an underground pipeline. The proposed permit contains limits for Total Residual Chlorine and Total Suspended Solids, as well as monitoring for pH.

The proposed action is to reissue an existing State/NPDES permit for an existing facility. This is a previous manufacturing site, which was identified by Bureau of Environmental Remediation (BER) to have groundwater contaminated with volatile organic compounds (VOC). Since 1991, this facility has been engaged in ongoing remediation efforts including groundwater extraction and treatment. Urban redevelopment of the site has resulted in demolition of most of the old factory buildings, which have been replaced with an office building and two parking lots. Groundwater extraction for the western half of the site (Factory A) is pumped from two wells (RW6 and RW7R) at a rate of 80 gallons per minute and treated with an air stripper prior to discharge to Outfall 004A. Groundwater extraction for the eastern half of the site (Factory B) is pumped from one well (RW5) at a rate of 40 gallons per minute and treated with an air stripper prior to discharge to Outfall 005A. The proposed permit contains limits for Trichloroethylene, Tetrachloroethylene, and pH; as well as monitoring for Flow, Total Chloride, Total Nitrogen, Total Phosphorus, and Radioactivity.

Persons wishing to comment on or object to the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and Environment (KDHE) if they wish to have the comments or objections considered in the decision-making process. All written comments regarding the draft documents, application or registration notices received on or before October 21, 2023, will be considered in the formulation of the final determination regarding this public notice. All comments received will be responded to at the time the Secretary of Health and Environment issues a determination regarding final agency action on each draft document/application. If response to any draft document/application indicates significant public interest, a public hearing may be held in conformance with K.A.R. 28-16-61 (28-46-21 for UIC). A request for public hearing must be submitted in writing and shall state the nature of the issues proposed to be raised during the hearing.
