Article 4.—INSTANT GAMES AND DRAWINGS

111-4-3547. 2023 Kansas State Fair second-chance drawing. (a) The Kansas lottery may conduct a second-chance drawing in conjunction with the Kansas State Fair event giving away five $500 cash prizes. The drawing will be on September 21, 2023, and the winners will be announced on September 22, 2023.

(b) To enter the drawing, a player shall purchase one or more Kansas lottery tickets with a total value of at least $20 in a single transaction at the Kansas lottery’s selling location at the Kansas State Fair. A player may purchase lottery products during the hours the Kansas lottery selling location at the Kansas State Fair is open each day to the public beginning September 8, 2023, through September 17, 2023. For each qualifying purchase, the player will be given an official entry form by the representative selling the ticket(s). A player shall complete the entry form in a legible manner and deposit the entry form into receptacles designated for the purpose of this drawing no later than 2:00 p.m. on September 17, 2023. Only one name shall appear on an eligible entry.

(c) After the close of entries, the entry forms shall be transported by Kansas lottery security officials, or security designee as appointed by the security person on duty, in a sealed container from the selling location at the Kansas State Fair to Kansas lottery headquarters and secured until the drawing occurs.

(d) On the designated date, the drawing shall be conducted by a drawing official designated by the executive director of the Kansas lottery in accordance with the Kansas lottery’s established drawing procedures.

Five entries shall be drawn. The person whose name appears on each valid entry drawn shall be the winner of a prize described in these rules. After five entries have been drawn and verified as valid, five more valid entries will be drawn, one at a time, which entries drawn will serve as alternate entries. The alternate entries will be marked in the order drawn, 1A, 2A, 3A, 4A, and 5A.

Each person who is selected as a prize winner in the drawing described above, will be sent an email with an electronic claim form attached, followed by the same documentation sent by U.S. mail. That winner must return his or her completed claim form, electronically, by U.S. mail, or hand-delivered to the Kansas lottery claims center, and the claim form must be received by the Kansas lottery within 14 days following the date the winners are announced. If the prize winner cannot be located, is declared ineligible, or fails to return the completed claim form in the allotted time, the prize will be awarded to an alternate winner. In the event an alternate winner is awarded a prize, that alternate winner must return his or her completed claim form, electronically, by U.S. mail, or hand-delivered, and the claim form must be received by the Kansas lottery within 14 calendar days following the date the alternate winner was sent a claim form electronically or by U. S. mail or another alternate will be selected until all alternates are exhausted. The Kansas lottery is not responsible for electronic malfunction or player error.

(e) There is no limit on the number of entries a person may make, but a person may only win one $500 prize.

(f) Eligible entrants in the 2023 Kansas State Fair second-chance drawing must be 18 years of age or older.

(g) The Kansas lottery shall not be responsible for any lost, destroyed, mutilated, illegible, or altered entries into the Kansas State Fair drawing. Illegible or incomplete entries shall be discarded.

(h) Rules applicable to this drawing are contained in K.A.R. 111-4-3547, K.A.R. 111-3-1 et seq., and K.A.R. 111-6-1 et seq. 111-4-3751. “Ca$h Windfall” instant ticket lottery game number 324. (a) The Kansas lottery may conduct an instant winner lottery game entitled “Ca$h Windfall.” The rules for this game are contained in K.A.R. 111-3-1 et seq. and 111-4-3751.

(d) The ticket numbers in each book of tickets in this game shall start with 000 and end with 014.

(e) The price of instant tickets sold by a retailer for this game shall be $20.00 each.

(f) “Ca$h Windfall” is an instant win game with one symbol match play area on the front of the ticket and three number match bonus play areas on the back of the ticket. Each area plays separately. On the front of the ticket, the player will scratch the play area to reveal 30 play symbols with a prize amount shown below each. If the player reveals a symbol of a bankroll, the player wins the prize amount shown below that symbol. If the player reveals a symbol of a $100 burst, $200 burst or $500 burst, the player instantly wins the amount of that symbol. On the back of the ticket, the player will scratch each of the separate bonus play areas to reveal one “WINNING NUMBER” in each bonus play area and five “YOUR NUMBERS” in each bonus play area with a prize amount shown below each “YOUR NUMBER.” If the player matches any “YOUR NUMBER” to the “WINNING NUMBER” in the same bonus game, the player wins the amount shown below the matching “YOUR NUMBER.”

(g) Each ticket in this game may win up to 45 times.

(h) Approximately 300,000 tickets shall be ordered initially for this instant game. Additional ticket orders shall have the same prize structure, the same number of prizes per prize pool of 240,000 tickets, and the same odds as were contained in the initial ticket order.

(d) The price of instant tickets sold by a retailer for this game shall be $5.00 each.

(e) “Super Red Hot Crossword” will feature four separate play areas: “YOUR LETTERS,” two “CROSSWORD” puzzles, and a “BONUS” area. The top puzzle grid will be imaged in black. The bottom puzzle grid will be imaged in red.

In the “CROSSWORD” games, the player will scratch the “YOUR LETTERS” play area to reveal 20 “YOUR LETTERS.” Each of the “YOUR LETTERS” may be used in both crossword puzzles. A player matches the corresponding letters in both crossword puzzles by removing the translucent scratch-off material covering the matching letter. If a player scratches a total of four or more completed words across both puzzles, the player wins the corresponding prize in the prize legend. The entire word must be uncovered to win the corresponding prize. Only the highest corresponding prize can be won.

In the “BONUS” play area, if a player reveals two matching prize symbols, the player wins that amount instantly. A player can win once in this game play area.

(f) To qualify as a complete word to win a prize in this game, the words revealed must meet the following requirements:

(1) must contain at least three letters;

(2) cannot be formed diagonally, run right to left or from bottom to top;

(3) must appear in an unbroken horizontal or vertical string of letters in the “crossword” puzzle;

(4) an unbroken string of letters cannot be interrupted by a black space and must contain every single letter square between two black spaces;

(5) every single letter in the unbroken string must be revealed in the “YOUR LETTERS” area and be included to form a word.

(g) Each ticket in this game may win up to two times.

(i) The expected number and value of instant prizes in this game shall be as follows:

Article 18.—GENERIC PLAYER LOYALTY CLUB RULES

111-18-2. Definitions. Unless otherwise provided in these regulations, all definitions contained in the Kansas lottery act shall apply to all regulations in this section and K.A.R. 111-19-1 et seq.

(a) “Account,” “PlayOn account,” or “player loyalty account” refers to a record of a member’s point activity.

(b) “APP” or “app” means a self-contained program or piece of software designed to fulfill a particular purpose such as an application downloaded by a user to a mobile device.

(c) “Challenges” refers to activities set forth in the player loyalty program which gives players the opportunity to earn points.

(d) “Collecting Points” means the accumulation of points in a player’s loyalty program account.

(e) “Download” means to copy data from one related computer system to another, typically over the Internet.

(f) “Drawing” or “online drawing” means the act of drawing or selecting winners by means of an electronic drawing or other method from among the entries that were entered for prizes.

(g) “Free Points Awards” means points collected by a player which are distributed from time to time from the player loyalty program as a bonus without requiring the player to earn the points.

(h) “Game ticket code(s)” refers to a draw game webcode or instant ticket code printed on Kansas lottery ticket products which can be entered by a member for the purpose of collecting points in the Kansas lottery’s player loyalty program.

(i) “Instant Ticket Code” refers to the code printed on Kansas lottery instant game tickets which is used by the member as a game ticket code.

(j) “Member” or “members” refers to a Kansas lottery player(s) who has completed a member profile, agreed to the terms of service, and is registered to participate in PlayOn.

(k) “Member Profile” refers to the personal data and releases that are collected from the player who joins the players loyalty program and which may serve as verification that a player is at least 18 years of age.

(l) “Mobile device” means a portable computing device, including but not limited to a smartphone or tablet.

(m) “Online entry” or “online entries” means the method of entering a contest, game, drawing, promotion or other event sponsored by the Kansas lottery’s player loyalty program by entering a ticket number or code electronically rather than via a physical ticket.

(n) “Non-winning ticket(s)” means any Kansas lottery ticket specifically designated by the Kansas lottery which is not a winner of any prize for the game in which it was originally eligible.

(o) “Player(s) Loyalty Program” refers to the Kansas lottery’s online loyalty program where a player can seek information and participate in activities, promotions and services related to the program including, but not limited to the opportunity to collect points by submitting eligible Kansas lottery game ticket codes. The players loyalty program can be accessed through the Kansas lottery’s website or any mobile version or mobile application (related apps) offered by the Kansas lottery.

(p) “PlayOn” refers to the name of the Kansas lottery’s player loyalty program, and which is a registered trademark of Pollard Banknote Limited used under license.

(q) “Points” refers to a variable number value system as set forth in the guidelines of the player loyalty program which are distributed to a player loyalty account. Points are collected by a member and used to participate in drawings, and other promotional offers as provided by the player loyalty program.

(r) “Random number generator” or “RNG” means the drawing machine or equipment used to randomly select the drawing winners.

(s) “Redemption of Points” means the act of a member releasing or using his or her points accumulated in the player’s respective player loyalty account in exchange for the opportunity to enter a drawing or to obtain other prizes or other promotional opportunities as set forth in the guidelines of the players loyalty program.

(t) “Registration” means the act of creating an official record in PlayOn by completing a member profile including the required fields and agreeing to the terms and conditions of PlayOn.

(u) “Rewards” refers to the prize or entry given to a member in exchange for point redemption.

(v) “Rewards Catalog” refers to a listing of prizes available to be selected by a member upon the redemption of points.

(w) “Second-chance drawings” or “second-chance prizes” refers to prizes later awarded in drawings that are entered from winning or non-winning tickets that were sold for a specific promotion.

(x) “Terms and Conditions” means the arrangements and conditions set out by the Kansas lottery in PlayOn to which a member agrees upon registration.

(y) “URL” means a location or address identifying where documents can be found on the Internet.

(z) “Webcode” refers to the code printed on Kansas lottery draw game tickets which is used by the member as a game ticket code.

(aa) “Winning ticket” means any Kansas lottery ticket specifically designated by the Kansas lottery which is a winner of any prize for the game in which it was eligible.

(bb) “www.kslottery.com” refers to the Kansas lottery’s website where a player can join the Kansas lottery’s player loyalty program. 111-18-3. PlayOn program overview; registration. (a) The PlayOn program shall be administered by Pollard Banknote Limited or a third party vendor approved by the Kansas lottery. PlayOn can be accessed through the Kansas lottery’s website at www.kslottery.com or any mobile version of PlayOn or mobile application which allows access to PlayOn. PlayOn offers Kansas lottery players various opportunities to earn and collect points which can be used to participate in drawings and other promotional opportunities.

(b) Any natural person, at least 18 years of age and who is a bona fide resident of the United States or a United States territory, is eligible to join PlayOn through the registration process which requires a player to complete a member profile and provide personal information, including but not limited to age verification. Members may be required to provide a physical address for shipping certain prizes or whenever required by the Kansas lottery for drawing, security, or other related purposes.

(c) Members can earn points by submitting eligible Kansas lottery ticket product code entries on the PlayOn site or mobile application and by participating in challenges and other activities or through free points awards offered by the Kansas lottery. A member is limited to entering a total of 50 tickets per calendar day, which includes game tickets for any second-chance drawing promotion.

(d) Members can use points to participate in drawings and other promotional offers provided by PlayOn.

(e) Points have no monetary or property value and shall not necessarily be associated with the face value of tickets.

(f) Point value will be revealed upon the successful submission of each eligible ticket or completion of a promotion or activity. Each eligible ticket has a point value based upon a range of values assigned by the Kansas lottery and is subject to change.

(g) Points are not transferable for any reason, including upon the death of a member or in a domestic dispute matter. Point balances from more than one account shall not be combined.

(h) Each member shall be responsible to ensure that his or her account points are properly credited. A member may submit a claim by email via the PlayOn “Contact & Support” link within five days of the date of claimed accrual of points; otherwise, such claims are null and void.

(i) Members are solely responsible for all activity on their accounts and for the security of their computer systems.

(j) Members shall be responsible for ensuring that the contact information provided for the account is current and valid. Failure to keep such information updated may result in forfeiture of prizes or disqualification from the PlayOn program.

(k) A member shall utilize no more than one single active PlayOn account.

(l) An account shall be deemed inactive if there has not been any activity associated with such account during the previous 365 days.

(m) Members enrolled in PlayOn are subject at all times to the terms and conditions, privacy policy, Kansas lottery rules, regulations, policies, directives, and procedures, the Kansas lottery act, and other applicable laws.

(n) Terms and conditions shall apply no matter how the programs described are accessed.

(o) The Kansas lottery PlayOn program shall be provided to individuals only. Corporations, associations, or groups may not participate in the program.

(p) Participation in PlayOn shall be voluntary and conditioned upon acceptance, without modification, of the terms and conditions and certification of eligibility requirements set forth in applicable regulations.

(q) Any activities associated with PlayOn shall be void where prohibited by law.

(r) All questions or disputes regarding eligibility for any PlayOn activities or member compliance shall be resolved by the Kansas lottery in its sole discretion.

(s) The Kansas lottery may send emails that include information that the Kansas lottery believes members may be interested in as a PlayOn member, including emails to reset passwords, account activity, and program updates.

(t) Members may discontinue receiving emails by opting out or cancelling their PlayOn membership. Upon cancellation of a PlayOn account, the cancelling member shall no longer have access to any PlayOn areas of the Kansas lottery website and related apps, and any points accrued to date of cancellation shall be forfeited.

(u) Members shall be responsible for the payment of any and all applicable taxes which may result from participation in any PlayOn activities and/or promotions unless those taxes are paid by the Lottery as part of a prize.

(v) Any content available on the PlayOn website and related apps which is owned by the Kansas lottery or other third parties is protected by copyrights, trademarks, and other intellectual property rights.

(w) A player must be a member of PlayOn to be eligible to participate in drawings, activities, and events sponsored by the player loyalty program.

(x) All information posted by a member in the PlayOn program becomes the property of the Kansas lottery to use as it deems necessary. Any re-use of information does not entitle a member to any future compensation.

(y) Prizes will be issued in the winner’s name only. The winner is the name that was entered during the PlayOn registration. 111-18-5. Drawings. (a) Following the close of drawing entries, a random number generator will be used to select winners of prizes.

(b) Drawing prizes may be cash or other prizes including second-chance prizes.

(c) All drawings shall be held under the supervision of Kansas lottery security staff members. Drawings may be conducted by Kansas lottery staff or vendor staff, at a location determined by the Kansas lottery. The drawings shall be conducted pursuant to written procedures developed by the Kansas lottery and approved by the executive director of the Kansas lottery.

(d) Persons interested in attending drawings are invited to receive detailed information by contacting the Kansas lottery director of security either by telephone, email, or by postal mail to: Security director, Kansas lottery, 128 North Kansas Avenue, Topeka, Kansas 66603. Requests to witness a drawing must be received by the Kansas lottery security director no less than 24 hours in advance of the drawing. Persons attending drawings conducted by the Kansas lottery must show valid photo identification and be supervised by a member of the Kansas lottery security division or a security designee during the drawing.

(e) A PlayOn member must be opted in for email including emails to reset password, account activity, and program updates to be eligible to be a drawing winner of the player loyalty program.

(f) Each person who enters a drawing agrees to release the Kansas lottery and its respective officers, directors, employees, agents, and sponsors from liability of any kind or nature for any loss, claims, damages, illness, or injuries of any kind associated with participation in the drawing or with acceptance and use of any prize.

(g) The Kansas lottery reserves the right to substitute prizes at its sole and total discretion of approximate equal value.

(h) A selected entry in a drawing will be reviewed by Kansas lottery security staff or designated vendor staff under Kansas lottery supervision to determine whether the entry meets qualifications for the drawing. If the entrant is declared to be an eligible entry, the entrant will be contacted via email address, telephone, and/or mailing address provided by the member’s account and must present acceptable matching identification of his or her registration information including verification of age eligibility prior to being awarded a prize. The selected entrant must complete, sign, and submit a furnished prize claim form within the time set forth in the specific rules for the drawing.

(i) Unless otherwise provided in the regulation establishing the drawing, there shall be five additional entries selected in each drawing which shall serve as alternate winners in the order drawn in the event a winner fails to properly claim a prize.

(j) If selected entrant(s) do not qualify for the drawing, cannot provide acceptable matching identification, or fail to submit a completed claim form within the time frame specified for the drawing, that entrant will not be awarded a prize and an alternate winner shall be selected in a like manner as the original entrant was selected from the entries for that drawing.

(k) Qualifying winning entrants will be determined by the Kansas lottery at its sole discretion.

(l) A winner or alternate winner of a prize shall be notified via email that he or she has won a prize. At that time, the winner or alternate winner shall be instructed how to verify his or her personal identification.

(m) A winner or alternate winner shall be sent a claim form via U. S. mail at the time the winner or alternate winner is notified he or she has won a prize.

(n) A player who is selected as a prize winner in a drawing must return his or her completed claim form, and must be received by the Kansas lottery within 10 days following the date of the winner is announced unless otherwise provided in the regulation establishing the drawing. A player who is determined to be a winner as a result of being used as an alternate winner in a drawing must return his or her completed claim form and must be received by the Kansas lottery within 10 days following the date the alternate winner was sent a claim form unless otherwise provided in the regulation establishing the drawing.

(o) Completed claim forms can be mailed by the winner or alternate winner via U.S. Mail to: Kansas lottery, 128 North Kansas Avenue, Topeka, Kansas 66603, emailed to an email address designated by the Kansas lottery, or the winner can deliver the completed claim form to the Kansas lottery claims center in Topeka, Kansas, during the hours the claim center is open for business.

(p) If a player fails to answer any email, respond to any request for information, or fill out any forms required by the Kansas lottery within the time allotted in the winner’s notification of winning a prize, said prize shall be forfeited and awarded to an alternate winner selected in a like manner as the original entrant was selected from the entries for that drawing.

(q) A drawing entry is eligible for only one drawing unless otherwise indicated in a specific drawing rule.

(r) A member may not win more than one prize in any drawing.

(s) All entries into a drawing are final.

(t) Drawing entries may not be cancelled or returned by a player, and any points used for an entry may not be returned or restored by the lottery. The Kansas lottery reserves the right to cancel or amend any entry at its sole discretion.

Article 19.—SPECIFIC PLAYER LOYALTY CLUB RULES

111-19-160. Sparkling Cash Family Bonus Promotion. (a) The Kansas lottery may conduct a “Sparkling Cash Family Bonus” promotion drawing awarding four cash prizes. The Kansas lottery will accept entries into the drawing beginning at 12:01 a.m. the day the instant tickets designated in subsection (b) are first offered for sale to the general public and ending at 11:59 p.m. on January 28, 2024. The drawing will be conducted sometime after entry into the drawing has closed but before noon on February 1, 2024, at which time the winners will be announced.

(b) The specific tickets eligible for entry into this drawing shall be the following Kansas lottery games: $2 “Sparkling Cash” game number 354; $5 “Sparkling Cash Winnings” game number 355; $10 “Sparkling Cash Wishes” game number 356; and $20 “Sparkling Cash Riches” game number 357.

(c) A player shall enter the drawings through the PlayOn program available at www.kslottery.com. The player shall follow the hyperlink specifically designated for the purpose of accessing the “Sparkling Cash Family Bonus” promotion. The player may enter the required data from the entry ticket manually for entry into the drawing. If the player does not enter the ticket data manually, the player may scan, if available, the ticket to enter data to be used for entry into the drawing using a mobile device and a downloaded Kansas Lottery PlayOn app. After the ticket data is successfully entered either manually or scanned using an app, the player will receive one entry per each dollar based on the cost of the ticket.

(d) The procedures set forth in K.A.R. 111-18-5 for selecting winners and alternate winners shall be followed. The first four winners selected will receive cash prizes. The first winner selected will receive $20,000, the second winner selected will receive $15,000, the third winner selected will receive $10,000 and the fourth winner selected will receive $5,000.

(e) There is no limit on the number of tickets a player may enter, but a player may only win one prize in this drawing.

(f) The procedures set forth in K.A.R. 111-18-5 for contacting winners and the claiming of prizes shall be followed, except that in this promotion the 10-day deadline for the four winners to return their claim forms shall commence with the date of the announcement of the winners. The Kansas lottery is not responsible for electronic malfunction or player error.

(g) By entering the promotion, entrant agrees to PlayOn terms and conditions.

(h) Winners are responsible for state and federal income taxes.

(i) Rules applicable to this promotion are contained in K.A.R. 111-19-160 and K.A.R. 111-18-1 et seq. (Authorized by K.S.A. 2022 Supp. 74-8710 and 74-8748; implementing K.S.A. 2022 Supp. 74-8710; effective, T-111-8-1-23, July 12, 2023.)

111-19-161. Maui Jim Maui Invitational Chaminade Experience Drawing. (a) The Kansas lottery may conduct a drawing entitled “Maui Jim Maui Invitational Chaminade Experience” awarding a trip prize package to the player selected as the winner. The Kansas lottery will accept entries into the drawing beginning at 12:01 a.m. on August 21, 2023, and ending at 11:59 p.m. on October 1, 2023. The drawing will be conducted sometime after entry into the drawing has closed but before noon on October 5, 2023, at which time the winner will be announced.

(b) Only registered Kansas Lottery PlayOn members may enter the drawing. PlayOn members must enter themselves into the drawing according to the terms and conditions of PlayOn. Entries shall not be accepted that are submitted by any method other than through PlayOn.

(c) A total of 1,480 player loyalty club points are required for a PlayOn member to enter once in the drawing. A player may enter the drawing as many times as his or her points allow.

(d) The procedures set forth in K.A.R. 111-18-5 for selecting the winner and alternate winners shall be followed.

(e) One drawing will be conducted to select a winner of a trip prize package for two persons to the Maui Jim Maui Invitational collegiate basketball tournament at the Lahaina Civic Center in Maui, Hawaii, from November 19 through November 24, 2023. The trip prize package shall include:

(1) Round trip coach airfare from an airport and on an airline approved by the Kansas lottery;

(2) Five nights’ hotel accommodations (double occupancy, room and tax only);

(3) Two tickets to one VIP event;

(4) Two tickets to three Kansas University men’s basketball games at the Maui Jim Maui Invitational;

(5) $250 Uber gift card;

(6) $1,000 VISA gift card;

(8) Two jerseys; and

(9) State and federal mandatory income withholding taxes paid by the Kansas lottery.

(f) The prize package is valued at approximately $13,802.82.

(g) The procedures set forth in K.A.R. 111-18-5 for contacting the winner and the claiming of the prize shall be followed, except that in this promotion the 10-day deadline for the winner to return their claim forms shall commence with the date of the announcement of the winner.

(h) The winner must travel by air on November 19, 2023, and November 24, 2023, or provide his or her own transportation to and/or from Maui.

(i) All winners and guests must comply with all applicable laws, and any terms, conditions, or restrictions applicable to any prize or portion of any prize, including but not limited to: airlines, hotels, concert or event venues, and all vouchers, certificates, or pre-paid gift cards. Lost, mutilated, or stolen tickets, vouchers, certificates, or pre-paid gift cards will not be replaced.

(j) Prizes are not exchangeable for cash. The Kansas lottery retains the right to substitute an alternate prize of approximate equal value.

(k) In the event the trip prize package awarded for this drawing is postponed, changed, or canceled in whole or in part, no cash prize substitutions shall be provided.

(l) All winners and guests shall release the Kansas lottery from any liability for injuries sustained while redeeming any portion of the prize.

(m) A player must have a smart phone to accept game tickets.

(n) By entering the drawing, entrant agrees to PlayOn terms and conditions.
