Notice of Hearing
In accordance with 40 CFR § 131.20, the Kansas Department of Health and Environment (KDHE) has prepared revisions to the Kansas Surface Water Quality Standards to submit in 2024 as the agency’s triennial review. Proposed revisions are to K.A.R. 28-16-28e(e) and the Tables of Numeric Criteria as adopted by reference.
A public hearing to discuss proposed changes and draft documents with interested parties will be held from 10:00 a.m. to 11:00 a.m. Wednesday, August 2, 2023, via Zoom. Register for the hearing at https://us02web.zoom.us/meeting/register/tZcvcuysrDIsHdDAqGGktNxOVq-E3fMqSiU4.
Audio will be available by the phone number and access code provided with the Zoom registration confirmation. In addition to the link for registering through Zoom, documents and content related to the hearing will be made available prior to the hearing at the Policy Planning and Standards Unit webpage at https://www.kdhe.ks.gov/1379/Policy-Planning-Standards-Unit.
Following the presentation, all interested individuals will be given a reasonable opportunity to present their comment orally on the proposed regulations. It is requested that each individual giving oral comment provide a written copy of the comment for the record by email or postal mailing address listed in this notice or by fax to the fax number also listed in this notice. In order to give each individual an opportunity to present their comment, it may be necessary for the hearing officer to request that each presenter limit an oral presentation of comment to an appropriate time frame.
The purpose of this hearing is to inform the public, stakeholders, and regulated community about proposed changes. The hearing will consist of outlining the proposed changes to the Kansas Surface Water Quality Standards and formal regulation revision process to follow this hearing, including a second public hearing, for the upcoming 2024 triennial review process followed with open discussion from interested parties. Content for discussion includes proposed changes to the Kansas Surface Water Quality Standards: Tables of Numeric Criteria, as adopted by reference at K.A.R. 28-16-28e(e). We request any comments following the public hearing be emailed to Dane.Boring@ks.gov by August 5, 2023.
