Senate Substitute for House Bill No. 2058
An Act concerning gaming; relating to sports wagering; authorizing any compact with a federally recognized Indian tribe to include provisions governing sports wagering outside the boundaries of Indian lands; amending K.S.A. 2022 Supp. 46-2305 and repealing the existing section.
Be it enacted by the Legislature of the State of Kansas:
Section 1. K.S.A. 2022 Supp. 46-2305 is hereby amended to read as follows: 46-2305. (a) If any federally recognized Indian tribe, as described in K.S.A. 74-9802(f), and amendments thereto, submits a request for negotiation of a gaming compact regarding sports wagering in accordance with K.S.A. 46-2302, and amendments thereto, the governor or the governor’s designated representative shall negotiate in good faith with such Indian tribe to enter into such gaming compact.
(b) No compact described in subsection (a) shall include sports wagering beyond the boundaries of the compacting tribe’s Indian lands, within the meaning of the Indian gaming regulatory act, 25 U.S.C. § 2701 et seq.
Sec. 2. K.S.A. 2022 Supp. 46-2305 is hereby repealed.
Sec. 3. This act shall take effect and be in force from and after its publication in the Kansas register.
