Notice of Hearing
A public hearing will be conducted by Kansas Development Finance Authority (“KDFA”) at 9:00 a.m. March 22, 2022, in KDFA’s conference room located at 534 S. Kansas Ave., Suite 800, Topeka, Kansas, regarding the issuance of its Multifamily Note (Santa Fe Trail Apartments Project), Series 2022H-1 (the “Governmental Note”) and its Multifamily Housing Revenue Bonds (Santa Fe Trail Apartments Project), Series 2022H-2 (the “Bonds”) (the Governmental Note and the Bonds, collectively, the “Obligations”). The Obligations are proposed to be issued in an amount not to exceed $4.5 million, plus related costs of issuance, cost of interest on the Obligations during the construction of the Project and any required reserves for the payment of principal and interest on the Obligations. The proceeds of the Obligations will be used to finance the costs of acquisition and rehabilitation of an existing 48-unit affordable multifamily housing property located at 308 Dakota St., 567 South St., 623 South St., and 650 Doniphan St. in Leavenworth, Kansas, known as Santa Fe Trail Apartments (the “Project”). The Project is being financed for Santa Fe Owner, LP (the “Borrower”). Debt service on the Obligations will the sole obligation of the Borrower and will include a pledge of facility revenues.
The Obligations shall not be deemed to constitute a debt or liability of the State of Kansas or of any political subdivision thereof other than KDFA or a pledge of the full faith and credit of the State of Kansas or of any such political subdivision other than KDFA, and neither the State of Kansas, nor any political subdivision thereof, will be liable on the Obligations nor will the Obligations be payable out of any funds other than those pledged and assigned under a loan agreement between KDFA and the Borrower. The issuance of the Obligations shall not directly, indirectly, or contingently obligate the state or any political subdivision thereof to levy any form of taxation therefor or to make any appropriation for the payment thereof.
This public hearing does not impose any liability on KDFA or the State of Kansas but is an accommodation by KDFA to satisfy the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended.
