Notice of Proposed Kansas/Federal Water Pollution Control Permits and Applications
In accordance with Kansas Administrative Regulations 28-16-57a through 63, 28-18-1 through 17, 28-18a-1 through 31 and 33, 28-16-150 through 154, 28-46-7, and the authority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been prepared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.
The proposed actions concerning the draft documents are based on staff review, applying the appropriate standards, regulations, and effluent limitations of the state of Kansas and the Environmental Protection Agency. The final action will result in a Federal National Pollutant Discharge Elimination System Authorization and/or a Kansas Water Pollution Control permit being issued, subject to certain conditions, revocation, and reissuance of the designated permit or termination of the designated permit.

The proposed action consists of renewal of a new Kansas/NPDES Water Pollution Control permit for the discharge of wastewater from the water treatment plant. This is an existing water treatment plant with a capacity to treat 105-150 gallons per minute of lake water for approximately 3-5 hours per day for a production of 27,000-30,000 gallons per day (gpd) of finished water. The facility previously used powdered activated carbon (PAC) prior to clarification for taste and odor control. The PAC system was not permitted and the facility has discontinued use of the PAC. Requirements for resuming use of the PAC are contained in Supplemental Condition 5. This permit contains limits for Total Residual Chlorine, Total Suspended Solids, and pH. This facility has a schedule of compliance. | ||

This action consists of renewal of an existing NPDES/Kansas Water Pollution Control Permit for an existing facility. CHS McPherson Refinery, Inc. (CHSMRI) is a refinery which processes approximately 115,000 bbl/day of crude oil into finished gasoline and diesel distillate. The main source water used at CHSMRI is from onsite water wells. In addition, up to 700 gpm of City of McPherson wastewater treatment plant effluent can be used for process purposes. As with the refinery well water, this water is treated in an onsite water treatment system using reverse osmosis, microfiltration and/or nanofiltration before being used in the refinery. This permit contains limits for Oil and Gas, TSS, BOD, Ammonia, pH, TMDL Chloride, and TMDL Phosphorus. The permit contains monitoring for Flow – MGD, COD, Selenium, Chloride, Total Phosphorus, TDL Chloride, Total Phosphorus, TMDL Phosphorus. | ||

This is an existing public water treatment plant producing up to 5.4 MGD of potable water. Raw water sources are the Wellington Lake, nine groundwater wells, and the Chikaskia River which is pumped directly into the Wellington Lake. There is no discharge from the domestic wastewater lagoons. Discharge from the process wastewater lagoons is directed to an earthen ditch that flows directly to Lake Wellington. Design flow of the process wastewater lagoon system is 0.121 MGD. This permit contains limits for Total Residual Chlorine, Total Suspended Solids, and pH. The permit contains monitoring Chloride. |

Permit application has been filed with the Department to permit five salt solution mining wells to be drilled in Section 23, T29S, R3W, Sedgwick County, Kansas. This area permit is for Lemon 3 Gallery, with area permit number KS-03-173-OLN3. The production of brine will be gallery system. An access borehole shall be plugged and abandoned within 90 days of the Lemon 3 Gallery being put into operation. |
Persons wishing to comment on or object to the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and Environment (KDHE) if they wish to have the comments or objections considered in the decision-making process. All written comments regarding the draft documents, application or registration notices received on or before April 26, 2025, will be considered in the formulation of the final determination regarding this public notice. Please refer to the appropriate Kansas document number (KS-AG-25-078/080, KS-AG-25-077, KS-Q-25-044/049, KS-EG-25-004) and name of the applicant/permittee when preparing comments.
All comments received will be responded to at the time the Secretary of Health and Environment issues a determination regarding final agency action on each draft document/application. If response to any draft document/application indicates significant public interest, a public hearing may be held in conformance with K.A.R. 28-16-61 (28-46-21 for UIC). A request for public hearing must be submitted in writing and shall state the nature of the issues proposed to be raised during the hearing.
