Notice of Hearing
The Kansas Department of Health and Environment (KDHE) is proposing a Lead Maintenance Plan as a revision to the Kansas Air Quality State Implementation Plan (SIP) for the partial Saline County, Kansas area designated by the United States Environmental Protection Agency (EPA) in November 2011 as a nonattainment area for the 2008 Lead National Ambient Air Quality Standards (NAAQS). The geographic lead nonattainment boundary surrounded the Stryten Salina, LLC (formerly Exide Technologies) lead acid battery manufacturing facility located in the city of Salina, Kansas. Air pollution control measures and requirements were subsequently established and implemented in the nonattainment area that resulted in measured ambient lead concentrations meeting the federal lead standard for the following three-year periods: 2017-2019, 2018-2020, and 2019-2021. Pursuant to federal Clean Air Act (CAA) Sections 107(d)(3)(D) and (E), the KDHE will request that the EPA concurrently approve a Lead Maintenance Plan, in accordance with CAA Section 175A, as a revision to the SIP and redesignate the partial Saline County lead nonattainment area to attainment status with respect to the 2008 Lead NAAQS. The maintenance plan not only is designed to ensure that the area maintains the 2008 Lead NAAQS for at least ten years after redesignation but also contains contingency measures that were required for the nonattainment area and will be implemented if a violation of the federal lead standard occurs following redesignation of the area to attainment.
The proposed SIP revision does not include any rulemaking action. However, a federally enforceable Air Emission Source Construction Permit, most recently modified on December 27, 2018, for the implementation and enforcement of additional control strategy improvements at the Stryten Salina, LLC facility, in addition to an attainment demonstration modeling, are included with the proposed maintenance plan and redesignation request for approval by the EPA. Any member of the public may request a public hearing or submit comments regarding this action. If requested, a public hearing for this action will be held at 10:30 a.m. Monday, February 24, 2025, at the Kansas Highway Patrol (KHP) Training Academy, 2025 E. Iron Ave., Salina, KS 67401. If no request for a public hearing is received by 5:00 p.m. February 13, 2025, the scheduled hearing will be canceled; and notice of the cancelation will be posted under the Planning tab of the KDHE Bureau of Air website cited above prior to 5:00 p.m. February 18, 2025. Public comments must be received no later than 5:00 p.m. February 24, 2025, to assure consideration.
