Article 2.—LOTTERY RETAILERS

111-2-331. Cosentino’s Price Chopper Grocery Give-A-Way. (a) The term of this promotion shall begin at 5:00 a.m. on December 2, 2024, and end at 8:59 p.m. on December 15, 2024.

(b) During the term of this promotion with participating chain numbers 1436 and 1732 Cosentino’s Price Chopper stores in Kansas, the player shall receive an entry for the “Grocery Give-A-Way” promotion drawing for each qualifying purchase. A qualifying purchase shall be a Super Kansas Cash purchase of $3 or more on a single ticket. Lottery terminals shall automatically dispense an entry form for each qualifying purchase at participating retailers during the term of this promotion. The qualifying purchase may be for a single draw or for multiple draws.

(c) During the term of this promotion, sealed drop boxes for the deposit of entries shall be provided by the Kansas lottery and placed at all participating retailer locations. All drop boxes shall be collected by participating retailers’ personnel at the end of the promotion and held for Kansas lottery personnel to conduct the drawing.

(d) Entry into the “Grocery Give-A-Way” promotion shall be accomplished as follows:

(1) During the term of this promotion, with every qualifying purchase an entry form shall be automatically produced by the lottery online terminal.

(2) The purchaser must complete the information on the entry form in a legible manner. Only one name shall appear on each entry form.

(3) The completed entry form must be placed into the designated drawing receptacle provided at any participating retailer location no later than 8:59 p.m. on December 15, 2024.

(4) The holder of the entry is not required to personally attend the drawing or be present at the time of the drawing to be determined a winner.

(5) The drawing shall be conducted by Kansas lottery personnel at Cosentino’s corporate office or at each participating retailer location during the week of December 15, 2024. One winner and two alternate entries per store shall be drawn using a bare arm technique, while looking away from the receptacle and removing only one ticket at a time from the receptacle in which all entries were placed.

(6) Only entry forms obtained during the term of this promotion may be entered in the drawing.

(e) The person whose name appears on the first entry drawn, for each participating retailer, shall be the winner of $100 in groceries. The second and third entries drawn, for each participating retailer, shall be marked 1A and 2A in the order drawn and shall be used as alternate winners in the event the prize winner cannot be contacted or does not qualify under the terms of this promotion to win a prize. The winner shall be contacted by phone at the phone number listed by the entrant on the entry form. The winner shall be instructed on how to verify his or her personal identification. If the winning entry does not qualify under the terms of this promotion or the winner is not able to be contacted within seven days from the date of the drawing, the prize shall be awarded to the first alternate winner in the same manner as the original winner. If the alternate winning entry does not qualify under the terms of this promotion or the alternate winner is not able to be contacted within 14 days from the date of the drawing, the prize shall be awarded to the second alternate winner in the same manner as the first alternate winner. If the second alternate winning entry does not qualify under the terms of this promotion or the second alternate winner is not able to be contacted within 21 days from the date of the drawing, the prize shall not be awarded. A claim form is not required to claim a prize in this drawing.

(f) Cosentino’s will provide each winner with a $100 Cosentino’s gift card. The Kansas lottery shall reimburse each participating retailer a $75 instant ticket credit. Cosentino’s will pay the additional $25 per store for the total $100 prize.

(g) There is no limit on the number of entries a person may make, but each person may only win once regardless of the place of entry.

(h) Eligible entrants in the promotion must be 18 years of age or older, and may not be an employee of any Cosentino’s Price Chopper store in Kansas. (Authorized by and implementing K.S.A. 2023 Supp. 74-8710; effective, T-111-10-10-24, Sept. 18, 2024.)

111-4-3811. “Hot 7s” instant ticket lottery game number 435. (a) The Kansas lottery may conduct an instant winner lottery game entitled “Hot 7s.” The rules for this game are contained in K.A.R. 111-3-1 et seq. and 111-4-3811.

The player will scratch the play area to reveal one “HOT NUMBER” and four “YOUR NUMBERS” with a prize amount shown to the right of each of the “YOUR NUMBERS.” If the player matches any “YOUR NUMBER” to the “HOT NUMBER,” the player wins the prize amount shown to the right of that number. If the player reveals a symbol of a 7 outlined, the player wins $5.

(g) Each ticket in this game may win up to four times.

(h) Approximately 1,800,000 tickets shall be ordered initially for this instant game. Additional ticket orders shall have the same prize structure, the same number of prizes per prize pool of 300,000 tickets, and the same odds as were contained in the initial ticket order.

Article 5.—MULTI-STATE ONLINE GAMES AND DRAWINGS

111-5-23. Definitions. The following definitions shall apply to the “Powerball” game:

(a) “Advertised grand prize” shall mean the estimated annuitized grand prize amount as determined by the MUSL central office by use of the MUSL annuity factor and communicated through the selling lotteries prior to the grand prize drawing. The “advertised grand prize” is not a guaranteed prize amount and the actual grand prize amount may vary from the advertised amount, except in circumstances where there is a guaranteed grand prize amount as described in these rules.

(b) “Computer pick” means the random selection of indicia by the computer, which appear on a ticket and are played by a player in the game.

(c) “Drawing” refers collectively to the formal draw event for randomly selecting the winning indicia which determine the number of winners for each prize level of the Powerball game and the Power Play multiplier. Winning indicia include the winning numbers for the Powerball game, and the Power Play multiplier.

(d) “Game board” or “board” means that area of the play slip which contains sets of numbered circles to be marked by the player.

(e) “Game ticket” or “ticket” means an acceptable evidence of play, which is a ticket produced in a manner that meets the specifications defined in these rules and is either:

(1) a physical representation of the play or plays sold to the player; or,

(2) electronic evidence of a ticketless transaction in the form of registered play.

(f) “Grand prize” refers to the top prize in the Powerball game.

(g) “Licensee lottery” shall mean a state lottery or lottery of a governmental unit, political subdivision, or entity thereof that is not a party lottery but has agreed to comply with all applicable MUSL and product group requirements and has been authorized by the MUSL and by the Powerball product group to sell the Powerball game.

(h) “MUSL” means the Multi-State Lottery Association, a government-benefit association wholly owned and operated by the party lotteries.

(i) “MUSL annuity factor” shall mean the annuity factor as determined by the MUSL central office through a method approved by the MUSL finance and audit committee and which is used as described in these rules.

(j) “MUSL board” means the governing body of the MUSL which is comprised of the chief executive officer of each party lottery.

(k) “Online lottery game” means a lottery game connected by telephone lines, satellite or other similar communication methodology, owned or controlled by the lottery, to a central computer in which each player selects numbers out of a larger predetermined set or sets of numbers.

(l) “Party Lottery” or “Member Lottery” means a state lottery or lottery of a political subdivision or entity which has joined the MUSL and, in the context of these Powerball product group rules, that is authorized to sell the Powerball game. Unless otherwise indicated, “party lottery” or “member lottery” does not include “licensee lotteries.”

(m) “Play” or “bet” means the six numbers, the first five from a field of 69 numbers and the last one from a field of 26 numbers, that appear on a ticket as a single lettered selection and are to be played by a player in the Powerball game.

(n) “Play slip” or “bet slip” means a card used in marking a player’s game plays and containing one or more boards.

(o) “Power play” or “multiplier option” means the Powerball game option whereby a player may elect to pay an additional $1 per play at the time of ticket purchase which will have the effect of multiplying any prize won on the play, except the grand prize.

(p) “Product group” means the group of lotteries which has joined together to offer a product pursuant to the terms of the multi-state lottery agreement and the product group’s own rules.

(q) “Registered play” means a wager where the play is owned by a specifically identified player through a means acceptable to the Kansas lottery, and which is recorded on the computer gaming system and internal computer system.

(r) “Retailer” or “agent” means a person or entity authorized by the Kansas lottery to sell lottery plays.

(s) “Selling lottery” means a lottery authorized by the product group to sell Powerball plays, including party lotteries and licensee lotteries.

(t) “Set Prize,” also referred to as “low-tier prize,” means all other prizes except the grand prize and, except in rare instances outlined in these rules, will be equal to the prize amount established by the MUSL Board for the prize level.

(u) “Terminal” means a device authorized by a party lottery to function in an online, interactive mode with the computer gaming system for the purpose of issuing lottery tickets and entering, receiving and processing lottery transactions, including purchases, validating tickets and transmitting reports.

(v) “Validation” or “validate” means the process of determining whether a ticket presented for a prize is a winning ticket.

(w) “Wallet” means an online service which tracks a player’s deposits, purchases, and prize payments. A player may make deposits, purchases, and withdrawals from the wallet according to the terms and conditions of the player loyalty program defined in K.A.R. 111-18-1, et seq.

(x) “Winning numbers” means the indicia randomly selected during a drawing event which shall be used to determine winning plays for the Powerball game contained on a game ticket. 111-5-24. Game description; retail sale of tickets. (a) “Powerball” is a five-out-of-69 plus one-out-of-26 numbers lottery game, drawn every Monday, Wednesday and Saturday as part of the Powerball drawing event, which pays the grand prize, at the election of the player made in accordance with the rules or by a default election made in accordance with these rules, either on an annuitized pari-mutuel basis, or as a single lump sum payment of the total funding held in the grand prize pool for the winning drawing on a pari-mutuel basis. Except as provided in these rules, all other prizes are paid on a single payment basis. Powerball winning numbers applicable to determine Powerball prizes will be determined in the Powerball drawing event. The drawing procedures shall include procedures for randomly selecting the Powerball game winning numbers and the Power Play multiplier.

To play “Powerball” a player shall select or computer pick five different numbers from one through 69 and one additional number from one through 26 for input into a terminal. The additional number may be the same as one of the first five numbers selected by the player.

(b) A “Powerball” play shall sell for two dollars.

(c) Plays shall not be sold to any person under the age of 18 years. Each retailer may require a person purchasing plays to produce proof of age.

(d) Each play shall be purchased from a terminal operated by a retailer. The player may select a set of five numbers and one additional number by:

(1) communicating the six numbers to the retailer;

(2) marking six numbered circles in any one game board on a play slip and submitting the play slip to the retailer; or

(3) requesting a computer pick from the retailer.

A player may choose the multiplier option by marking the appropriate box on the play slip or by communicating to the retailer the desire to play the multiplier option. If the multiplier option is chosen, it shall apply to all boards played on that play slip. For each board upon which the multiplier option is chosen, the player shall pay one additional dollar.

The retailer shall then issue a ticket from the terminal containing the selected set or sets of numbers, each of which constitutes a game play, and if applicable, whether or not the multiplier option has been chosen for all plays on that play slip.

(e) A player may purchase a registered play from the Kansas lottery. The player may select a set of five numbers and one additional number by:

(1) marking six numbered circles in any one game board on a play slip made available by the Lottery and submitting the play slip to the Lottery; or

(2) requesting a computer pick from the Lottery in a form and manner acceptable to the Lottery.

(f) A validated ticket shall be the only proof of a game play or plays. The only method of claiming a prize or prizes shall be the submission of the winning ticket to and receipt of the ticket by the lottery or its authorized agent. A play slip shall have no pecuniary or prize value and shall not be used as evidence of a play purchase or of numbers selected.

(g) A play may not be voided or cancelled by returning the ticket to the selling retailer, including tickets that are printed in error. The Kansas lottery has an approved method of compensating retailers for plays that are not transferred to a player for reasons acceptable to the Kansas lottery. No play that is eligible for a prize can be returned to the Kansas lottery for credit. Plays accepted by retailers as returned plays and that cannot be re-sold shall be deemed owned by the bearer thereof unless the ticket has been signed.

(h) Ticket sales will end at approximately 8:59 p.m. central time (CT) on Wednesdays, Saturdays and Mondays, and will resume at approximately 9:05 p.m. central time (CT).

(i) Drawings will be conducted three times weekly, on Wednesdays, Saturdays, and Mondays, at approximately 9:58 p.m. central time (CT), after the game is closed at approximately 8:59 p.m. central time (CT) and the draw official has verified that the game is closed, under conditions and procedures promulgated by the executive director of the lottery.

(j) Each player shall be responsible for verifying the accuracy of the game play or plays and other data printed on the ticket. The placing of plays is done at the player’s own risk and the Kansas lottery or a retailer entering a play shall be deemed to be acting on behalf of the player in entering the play. 111-5-28. Prize payments; annuitized and cash prizes. (a) Grand prizes shall be paid, at the election of the player made no later than 60 days after the player becomes entitled to a prize, as either a per winner annuity or cash payment. If the payment election is not made at the time of purchase and is not made by the player within 60 days after the player becomes entitled to the prize, then the prize shall be paid as an annuity prize. An election for an annuity payment made by a player before ticket purchase or by system default or design may be changed to a cash payment at the election of the player until the expiration of 60 days after the player becomes entitled to the prize. The election to take the cash payment may be made at the time of the prize claim or within 60 days after the player becomes entitled to the prize. An election made after the winner becomes entitled to the prize is final and cannot be revoked, withdrawn or otherwise changed. Shares of the grand prize shall be determined by dividing the cash available in the grand prize pool equally among all winning plays of the grand prize. Winner(s) who elected a cash payment shall be paid their share(s) in a single cash payment. The annuitized option prize shall be determined by multiplying a winner’s share of the grand prize pool by the MUSL annuity factor. The MUSL annuity factor is determined through a process as approved by the MUSL finance and audit committee. Neither MUSL nor the party lotteries shall be responsible or liable for changes in the advertised or estimated annuity prize amount and the actual amount of tickets purchased after the prize payment method is actually known to MUSL. In certain instances announced by the product group, the grand prize shall be a guaranteed amount and shall be determined pursuant to subsection (f) of K.A.R. 111-5-28. If individual shares of the cash held to fund an annuity are less than $250,000, the product group, in its sole discretion, may elect to pay the winners their share of the cash held in the grand prize pool of the annuity. All annuitized prizes shall be paid annually in 30 payments with the initial payment being made in cash, to be followed by 29 payments funded by the annuity. All annuitized prizes shall be paid annually in 30 graduated payments (increasing each year) by a rate as determined by the product group. Prize payments may be rounded down to the nearest one-thousand dollars ($1,000). Annual payments after the initial payment shall be made by the lottery on the anniversary date, or if such date falls on a non-business day, then on the first business day following the anniversary date of the selection of the grand prize winning numbers. Funds for the initial payment of an annuitized prize shall be made available by MUSL for payment by a party lottery by the fifteenth calendar day following the drawing or the next banking day if the fifteenth day is a non-business day. If necessary, when the due date for the payment of a prize occurs before the receipt of funds in the prize pool trust sufficient to pay the prize, the transfer of funds for the payment of the full lump sum cash option amount may be delayed pending receipt of funds from the selling lotteries. A state may elect to make the initial payment from its own funds after validation, with notice to MUSL. If a party lottery purchases or holds the prize payment annuity for a prize won in that jurisdiction, that party lottery’s game rules, and any prize payment agreement with the prize winner, shall indicate that the prize winner has no recourse on the MUSL or any other party lottery for payment of that prize.

(b) In the event of the death of a lottery winner during the annuity payment period, the MUSL finance and audit committee, in its sole discretion excepting a discretionary review by the product group, upon the petition of the estate of the lottery winner to the lottery and subject to federal, state, or applicable laws, may accelerate the payment of all of the remaining lottery proceeds to the estate. If such a determination is made, then securities and cash held to fund the deceased lottery winner’s annuitized prize may be distributed to the estate. The identification of the securities to fund the annuitized prize shall be at the sole discretion of the product group.

(c) All prizes (whether described as “cash” payment prizes or otherwise) shall be paid through the selling lottery which sold the winning play(s) and at the discretion of the selling lottery that sold the winning play(s) may be paid by cash, check, warrant, or electronic transfer. A selling lottery may begin paying low-tier cash prizes after receiving authorization to pay from the MUSL central office. If a selling lottery, due to jurisdictional law requirements, separately determines its low-tier prize amounts, it shall be solely responsible for its low-tier prize liability, and may begin paying low-tier prizes after a drawing when it determines it is appropriate to do so.

(d) Annuitized payments of the grand prize or a share of the grand prize may be rounded to facilitate the purchase of an appropriate funding mechanism. Breakage on an annuitized grand prize win shall be added to the first cash payment to the winner or winners. Prizes other than the grand prize, which, under these rules, may become single-payment, pari-mutuel prizes, may be rounded down so that prizes can be paid in multiples of whole dollars. Breakage resulting from rounding these prizes shall be carried forward to the prize pool for the next drawing.

(e) If the grand prize is not won in a drawing, the prize money allocated for the grand prize shall roll over and be added to the grand prize pool for the following drawing.

(f) The product group may offer guaranteed minimum grand prize amounts or minimum increases in the grand prize amount between drawings or make other changes in the allocation of prize money where the product group finds that it would be in the best interest of the game. If a minimum grand prize amount or a minimum increase in the grand prize amount between drawings is offered by the product group, then the grand prize shares shall be determined as follows. If there are multiple grand prize winners during a single drawing, each selecting the annuitized option prize, then a winner’s share of the guaranteed annuitized grand prize shall be determined by dividing the guaranteed annuitized grand prize by the number of winning plays. If there are multiple grand prize winners during a single drawing and at least one of the grand prize winners has elected the annuitized option prize, then the best bid submitted by MUSL’s pre-approved qualified brokers shall determine the cash pool needed to fund the guaranteed annuitized grand prize. If no winner of the grand prize during a single drawing has elected the annuitized option prize, then the amount of cash in the grand prize pool shall be an amount equal to the guaranteed annuitized amount divided by the MUSL annuity factor. Changes in the allocation of prize money shall be designed to retain approximately the same prize allocation percentages, over a year’s time, set out in these rules. Minimum guaranteed prizes or increases may be waived if the alternate funding mechanism set out in K.A.R. 111-5-26 becomes necessary. Approval of the product group is required to change the guaranteed minimum grand prize amounts or minimum increases in the grand prize amount. Any reduction in the guaranteed minimum grand prize amount or reduction in the minimum increases to the grand prize amount shall not become effective until after a grand prize win following the action taken by the product group.

(g) The holder of a winning play may win only one prize per play in connection with the winning numbers drawn, and shall be entitled only to the prize won by those numbers in the highest matching prize category.

(h) All prizes must be claimed within 365 days of the day of the drawing in which the prize was won, except prizes arising from registered plays must be claimed within 180 days of the day of the drawing in which the prize was won. 111-5-30. Claiming prizes; procedure and time period. (a) Prior to the payment of any prize, each ticket shall be validated by the retailer or lottery office pursuant to this act.

(b) The procedures for payment of a “Powerball” prize on any single printed game ticket of $599 or less, except for a grand prize, are as follows:

(1) The claimant of a ticket purchased in Kansas may present the ticket to any Kansas lottery on-line retailer. Upon validation of the ticket, the retailer shall immediately make payment for the prize to the claimant. If the retailer cannot validate the ticket, the claimant shall fill out a claim form provided by the retailer and personally present or mail the completed form together with the ticket to the office of the Kansas lottery. If the ticket is validated, then payment shall be made to the claimant by mail.

(2) The claimant may bring the ticket to the office of the Kansas lottery during the hours that the office is open to the public for business. Upon validation of the ticket, and completion of a claim form, payment shall be processed for the claimant.

(3) The claimant may mail the ticket with a completed claim form in any envelope to the office of the Kansas lottery. Claim forms may be obtained from any lottery retailer or from the Kansas lottery. Upon receipt of the ticket and completed claim form and validation of the ticket, payment shall be processed for the claimant.

If any evidence of alteration, mutilation, tear, or other ambiguity appears on the ticket, the retailer shall not make direct payment of a prize. The claimant shall submit a claim form with the ticket to the lottery.

(c) The procedure for the payment of a Powerball prize on any single printed game ticket which exceeds $599 or more shall be as follows:

(1) The claimant may bring the signed ticket to the office of the Kansas lottery during the hours that the office is open to the public for business. Upon validation of the ticket and completion of a claim form, payment shall be processed for the claimant.

(2) The claimant may mail the ticket with a completed claim form to the office of the Kansas lottery. Claim forms may be obtained from any lottery retailer or from the Kansas lottery. Upon receipt of the ticket and completed claim form and validation of the ticket, payment shall be processed for the claimant.

(d) If a prize is claimed by mail, the ticket and claim form must actually be received by the lottery within the claim period.

(e) All prizes shall be claimed within 365 days of the drawing in which the prize was won, except prizes arising from registered plays must be claimed within 180 days of the day of the drawing in which the prize was won. Any prize or prizes not claimed within the time specified shall be forfeited.

(f) Payment of a Powerball prize of $599 or less on a registered play shall be paid to the winner’s wallet upon validation of the ticket.

(g) Payment of a Powerball prize in excess of $599 on a registered play shall be paid to the winner’s wallet upon validation of the ticket and after the winner has completed a claim form provided by the Kansas lottery. The winner shall be required to provide additional information including a complete social security number, bank account and routing numbers, or other information reasonably required to verify the winner’s identity and pay the prize if that information was not provided during account registration in the lottery’s player loyalty program defined in K.A.R. 111-18-1 et seq. Article 19.—SPECIFIC PLAYER LOYALTY CLUB RULES

111-19-192. Hot 7s Family Bonus Drawings. (a) The Kansas Lottery may conduct promotional drawings for each of the six instant ticket games listed in subsection (b) entitled “Hot 7s Family Bonus Drawings” awarding cash prizes to players selected as winners. Entries into the drawings will be accepted beginning at 12:01 a.m. on the day the instant tickets are first offered for sale to the general public and ending at 11:59 p.m. on September 28, 2025. The drawings will be conducted sometime after entry into the drawings has closed but before noon on October 2, 2025, at which time the winners will be announced.

(b) The specific tickets eligible for entry into these drawings shall be the following Kansas Lottery instant ticket games: $1 “Hot 7s” game number 435; $2 “Burning Hot 7s” game number 436; $5 “Blazing Hot 7s” game number 437; $10 “Smoking Hot 7s” game number 438; $20 “Scorching Hot 7s” game number 439; and $30 “Fiery Hot 7s” game number 440.

(c) A player shall enter the drawings through the Kansas Lottery PlayOn program available at www.kslottery.com. The player shall follow the hyperlink specifically designated for the purpose of accessing the “Hot 7s Family Bonus Drawings” promotion. The player may enter the required data from the entry ticket manually for entry into the drawings. If the player does not enter the ticket data manually, the player may scan, if available, the ticket to enter data to be used for entry into the drawings using a mobile device and a downloaded Kansas Lottery PlayOn app. After the ticket data is successfully entered either manually or scanned using the app, the player will receive one entry into the drawings based on the specific ticket.

(d) The procedures set forth in K.A.R. 111-18-5 for selecting winners and alternate winners shall be followed. The first entrant selected in each drawing shall be the winner of a cash prize.

(1) The first drawing conducted shall be from among the entrants in the $1 Hot 7s, game number 435, drawing. The cash prize awarded to the first entrant selected in the first drawing shall be $1,000.

(2) The second drawing conducted shall be from among the entrants in the $2 Burning Hot 7s, game number 436, drawing. The cash prize awarded to the first entrant selected in the second drawing shall be $2,000.

(3) The third drawing conducted shall be from among the entrants in the $5 Blazing Hot 7s, game number 437, drawing. The cash prize awarded to the first entrant selected in the third drawing shall be $5,000.

(4) The fourth drawing conducted shall be from among the entrants in the $10 Smoking Hot 7s, game number 438, drawing. The cash prize awarded to the first entrant selected in the fourth drawing shall be $10,000.

(5) The fifth drawing conducted shall be from among the entrants in the $20 Scorching Hot 7s, game number 439, drawing. The cash prize awarded to the first entrant selected in the fifth drawing shall be $15,000.

(6) The sixth drawing conducted shall be from among the entrants in the $30 Fiery Hot 7s, game number 440, drawing. The cash prize awarded to the first entrant selected in the sixth drawing shall be $20,000.

(e) There is no limit on the number of tickets a player may enter. A player may win more than one drawing.

(f) The procedures set forth in K.A.R. 111-18-5 for contacting a winner and the claiming of the prize shall be followed. The Kansas Lottery is not responsible for electronic malfunction or player error.

(g) By entering the promotion, entrant agrees to PlayOn terms and conditions.

(h) Winners are responsible for any state and federal taxes.
