Notice of Public Auction

The Kansas Turnpike Authority (Seller) will offer for sale at public auction land that it owns and which is no longer necessary to meet its lawful objectives.

The property is located in the northwest ¼ of Section 5, Township 24 South, Range 7 East in El Dorado, Butler County, Kansas generally described as follows:

  • The property is located adjacent to I-35 (KTA). The property is southeast of the county road NE 120th bridge that goes over the KTA.
  • The property consists of portions of original KTA Right of Way Tracts 14-5, and 14-6 minus an approximately 150 foot to the centerline of I-35 (KTA) on the northwest of the property and 75 foot setback from county road NE 120th street, informally described as the portions of original KTA Right of Way Tracts 14-5, 14-6 that lie outside of the existing I-35 (KTA) Right of Way fence.
  • KTA Right of Way fence will stay in place however, the fence south of county road NE 120th street will be adjusted by the KTA to match the 75 foot set back from centerline of the county road after the auction.
  • The property consists of 11.7 acres, more or less.

Inspection of property will take place from 10:00 a.m. to 10:30 a.m. Tuesday, November 5, 2024.

Sale will be conducted at 11:00 a.m. Tuesday, November 12, 2024, at the Kansas Turnpike Authority El Dorado Maintenance Facility, 235 SW Boyer Rd., El Dorado, KS 67042. Opening and minimum acceptable bid will be $49,000. Seller reserves the right to reject any and all bids.

This property fronts a graveled county road (NE 120th Street) along its northeast line.

Zoning

The property has no zoning designation, since it has been a part of highway right of way. Properties in the area are zoned agricultural.

Terms of Sale

Cashier’s check for $4900 representing ten percent (10%) of the minimum acceptable bid, is due at the time of the sale.

The exact legal description of the property shall be determined by survey prior to closing, which shall be used as described below. The survey shall be by a Kansas licensed surveyor, sealed and include a drawing depicting the described parcel labeled as “Exhibit A.” Said survey shall be obtained and paid for by Seller.

The accepted high bid from the buyer on the day of auction shall establish the purchase price. The purchase price is predicated on a property size of 11.7 acres. A unit value expressed in dollars($)/acre will be established by subtracting the cost of survey and title work ($4800) from the purchase price then diving the difference by 11.7. The purchase price shall be adjusted based on the final property size as determined by the above referenced legal description. The adjusted purchase price will be included in the Contract to Purchase.

The buyer will receive a Contract to Purchase, with the balance of adjusted purchase price less the $4900 deposit, upon completion and approval by the KTA of the legal description.

The buyer will receive a Quit Claim Deed after balance of the Contract to Purchase amount is paid. If the balance of the purchase price is not paid within 30 days of receipt of the Contract to Purchase, the ten percent (10%) down payment will be forfeited to the Seller.

Any description of the property is for information purposes only, and no representations, warranties or guarantees are made concerning locations, dimensions, or tract size or nature or quality or suitability for use of the tract for any improvements. Should a dispute arise after the auction, the Seller’s records will be conclusive in all respects.

Sold Subject to the Following

Tract will be sold subject to any existing easements, restrictions or reservations of record.

The prospective buyer is encouraged to research the chain of title of this tract.

KTA makes no representations concerning the condition, value or suitability of use for this property or the improvements, attachments, or fixtures thereof, if any. The property and said improvements, etc. will be sold in the present “as is” condition, without warranties or guarantees of any kind. It is not KTA’s intent to impose any restrictions not already in existence on the property. KTA has no specific knowledge about such restrictions, but does not warrant the property to be free of restrictions either.

KTA insures the acceptance of any bid pursuant to this notice will be without discrimination on the grounds of sex, race, color, religion, physical handicap or national origin.
