Notice of Water Quality Certification

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) as requested by 3500 Iowa Development/Holdings, LLC. Per Public Notice No. NWK-2024-00189 for project found at https://usace.contentdm.oclc.org/utils/getfile/collection/p16021coll15/id/5512. Specific activities covered under this mix used residential and commercial development project include impacts to a total of 763 linear feet (lf) of stream, and 5.576 acres (ac) of wetland: Stream impacts are proposed to include a 125lf culvert structure under a road crossing, and grading, stabilization, and realignment of 638lf near the east boundary (including a reduction of overall stream length by approximately 74lf). Waters identified within the project area include 3,063lf of the Wakarusa River along the south border of the site, 2,716lf of a stream channel that flows east into the neighboring Baker University Wetlands, and 12 wetlands totaling 12.604ac.

The draft conditional 401 certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before August 22, 2024. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by September 22, 2024, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
