Notice of Right to Request a Hearing Regarding the Proposed Revocation of Administrative Regulations

Pursuant to K.S.A. 77-440, the Kansas Department of Health and Environment (KDHE), submitted a report to the Joint Committee on Administrative Rules and Regulations summarizing the review of the agency’s administrative regulations and identifying regulations that are not necessary for the implementation and administration of state law. Pursuant to K.S.A. 77-426(d), KDHE proposes to revoke 49 of the regulations identified in that report by filing a notice of revocation with the Secretary of State. Pursuant to K.S.A. 77-426(d)(2)(A), KDHE will schedule a public hearing on the notice of revocation only upon the written request of a member of the public. The period to receive written comment from members of the public is 30 days from the date of publication in the Kansas Register of this Notice of Right to Request a Hearing Regarding the Proposed Revocation of Administrative Regulations.

The following regulations are proposed for revocation because they duplicate existing statute, do not reflect current practices, or are inconsistent with statute.
