Notice of Proposed Permit Modification
The Kansas Department of Health and Environment (KDHE) is preparing to issue a Resource Conservation and Recovery Act (RCRA) Class III Permit Modification for Chemical Waste Management, Inc., (owner/operator) of the closed commercial hazardous waste landfill facility located at 8808 N. 127th St. E, Valley Center, KS 67147-8423. The Secretary has also found cause, under 40 CFR §270.41(a)(2), to modify the conditions of the permit due to new information not available at the time of permit issuance.
The Class III permit modification is being proposed under 40 CFR §270.42(c) to address newly detected contaminants of concern consisting of 1,4-dioxane, total arsenic, and total chromium in groundwater samples during the Spring 2023 monitoring event. The owner/operator also proposed changes to Permit Condition IV.D.5.e. to change the reporting intervals and, if needed, allow for the addition of newly detected constituents to the Groundwater Protection Standard. Other modifications involve updated survey elevation data for repaired monitoring wells and corrections of typographical errors. The permit modification will require the owner/operator to collect additional samples for the new constituents along with dissolved arsenic and dissolved chromium at select wells. Due to the incompatibility of 1, 4-dioxane with the current groundwater treatment system, KDHE is also modifying the permit by adding Condition IV.C.3.g. that will require the facility to enhance the groundwater treatment system to reduce concentrations of 1,4-dioxane to below KDHE Risk-Based Standards.
Copies of the Class III Permit Modification documents and KDHE initiated modification are available for review at the Kansas Department of Health and Environment, Bureau of Waste Management, Office of Hazardous Waste Permits, 1000 SW Jackson, Suite 320, Topeka, KS 66612-1366 and the Park City Public Library located at 2107 E. 61st St. N, Park City, KS 67219 from August 8, 2024 to September 23, 2024. All data submitted by the applicant of the Draft Permit Modification are available as part of the Administrative Record. Select documents can also be accessed on the KDHE website at https://www.kdhe.ks.gov/621/Hazardous-Waste-Public-Notices. Written comments related to this permit modification action should be addressed to Jesse Higginbotham at Kansas Department of Health and Environment, Hazardous Waste Permits Section, 1000 SW Jackson, Suite 320, Topeka, KS 66612 and postmarked no later than September 23, 2024.
A public hearing has not been scheduled; however, if written requests are received indicating significant public interest in the modified Draft Permit, a public hearing will be scheduled. The Secretary will consider all comments received during the public hearing and comment period. When the final decision to approve or deny the permit modification is made, notice will be given to the applicant, all persons who submitted written comments and anyone who requested notice of the final permit decision.
