Notice of Hearing on Proposed Administrative Regulations
A public hearing will be conducted by the staff of the Behavioral Sciences Regulatory Board (BSRB) from 10:00 a.m. to 11:00 a.m. Tuesday, March 26, 2024, in the BSRB conference room, 700 SW Harrison St., Suite 420, Topeka, Kansas, to consider proposed changes to administrative regulations for several professions regulated by the BSRB. There is metered parking all around the Eisenhower State Office Building. The public entrance is on the north side of the building. To ensure that there is adequate space for public attendees, all individuals wishing to attend the hearing must notify David Fye, Executive Director for the BSRB, no later than two business days prior to the hearing by sending an email to david.fye@ks.gov. At the hearing all interested parties will be given a reasonable opportunity to present their views orally. To give all parties an opportunity to present their views, it may be necessary to request each participant limit any oral presentation to five minutes or less, depending on the number of attendees that wish to speak. Oral comments will be recorded by staff members of the BSRB and summarized for the Board at the next full Board meeting when changes or adoption of the regulations are considered by the Board.
Any individual with a disability may request accommodation to participate in the public hearing and may request the proposed regulations and economic impact statement in an accessible format. Requests for accommodation to participate in the hearing should be made at least five business days in advance of the hearing by contacting Leslie Allen, Assistant Director, at 785-296-3240 or leslie.allen@ks.gov.
This 60-day notice of the public hearing constitutes a public comment period for purposes of receiving written public comments on the proposed amendments. All interested parties may submit written comments prior to the hearing to David Fye, Executive Director, Behavioral Sciences Regulatory Board, 700 SW Harrison St., Suite 420, Topeka, KS 66603. Email comments may be directed to david.fye@ks.gov.
A copy of the full text of the regulations and the economic impact statement may be reviewed or obtained at the board office. They are also available on the board website at http://www.ksbsrb.ks.gov under proposed regulations. The board does not have a less costly or less intrusive method for achieving the stated purpose of these regulations. These proposed changes to regulations primarily involve updating and modernizing alternate educational requirements for licensure for license applicants who attended non-accredited schools, including allowing an “in-residence” requirement to be met either in person or by synchronous video conferencing for the social work, professional counseling, marriage and family therapy, and addiction counseling professions; expanding the list of qualifying degrees needed to be held by the person chairing or directing a professional counseling program; recognizing a national accrediting body for the addiction counseling profession to satisfy educational requirements for licensure; and eliminating a distinction between “core faculty” and other faculty for the master’s level psychology profession. Several other changes include synching regulations with language in recently passed legislation and adding clarifying language for master’s level addiction counselors.
Economic Impact
It is estimated that these changes will increase overall revenue by $1,600 in FY 2025 and each year beyond, through additional individuals meeting the requirements for licensure. Of this amount, $1,440 would be revenue for the BSRB Fee Fund and $160 be revenue for the State General Fund.
