Notice of Hearing on Proposed Administrative Regulations

A public hearing will be conducted at 10:00 a.m. Friday, March 15, 2024, in Room 1033 of the Department for Children and Families Administration Building, 555 S. Kansas Ave., Topeka, Kansas, to consider the adoption of proposed rules and regulations of Family First Prevention Services and Family Foster Home Licensing, Department for Children and Families (DCF).

This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed rules and regulations. All interested parties may submit written comments prior to the hearing to Leslie Rannebeck at leslie.rannebeck@ks.gov. All interested parties will be given a reasonable opportunity to present their views orally regarding the adoption of the proposed regulations during the public hearing. In order to provide all parties an opportunity to present their views, it may be necessary to request that each participant limit any oral presentation to five minutes.

Any individual with a disability may request an accommodation in order to participate in the public hearing and may request the proposed regulations and economic impact statements in an accessible format. Child Placement Agencies Regulations and Economic Impact Statement

Foster Home Licensing

Summaries of the proposed regulations follow. Because responsibility for licensing of child placement agencies and foster homes was transferred from the Kansas Department of Health and Environment (KDHE) to DCF, some KDHE regulations are revoked. Other regulations have been moved to DCF and are either new or amended for clarity and to implement changes in state statute and federal legislation that are already in effect.

The proposed regulations K.A.R. 30-47-900 through 30-47-910 and 30-47-912 through 30-47-922 are needed to implement federal requirements pertaining to the Family First Prevention Services Act (FFPSA) and Prevent Sex Trafficking and Strengthening Families Act, H.R. 4980. This law establishes prudent parent standards throughout the United States. Kansas meets these requirements. Kansas Department for Children and Families Child Placement Agency regulations serve as the state’s health and safety standards, including the requirements for preparation and training of providers.

The proposed regulation 30-47-312 is needed to implement K.S.A. 65-534.

Pursuant to K.S.A. 75-3084 and K.S.A. 75-3085, responsibility for foster care licensing was transferred from KDHE to DCF. These regulations, 28-4-170, 28-4-171, 28-4-172 through 28-4-178, 28-4-800, 28-4-801, 28-4-803, 28-4-804, 28-4-805, 28-4-806, 28-4-807, 28-4-808, 28-4-809, 28-4-810, 28-4-811, 28-4-812, 28-4-813, 28-4-814, 28-4-815, 28-4-816, 28-4-817, 28-4-818, 28-4-819, 28-4-820, 28-4-821, 28-4-822, 28-4-823, 28-4-824, 28-4-825, are being revoked as they are no longer applicable to KDHE.

DCF Families is revoking K.A.R. 30-47-3 as it is replaced by K.A.R. 30-47-802.

The proposed regulations K.A.R. 30-47-800 through 30-47-811, 30-47-813, and 30-47-815 through 30-47-825 are needed to implement regulations applicable to Family Foster Homes (FFH) pursuant to K.S.A. 75-3084 and K.S.A. 75-3085, transferring responsibility for foster care licensing from KDHE to DCF and meeting the definition of child care facility in K.S.A. 65-503. Family foster homes are recruited, trained and sponsored by child placement agencies, which may be private or public entities.

Economic Impact

Additional costs will be assumed by either the Child Placement Agencies or a Family Foster Home to meet the federal requirements for all caregivers to be trained and maintain certification in CPR and all caregivers caring for a child under the age of 1 to receive a flu vaccine.

License fees will be assessed as stated in K.S.A. 65-505.
