Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications
In accordance with Kansas Administrative Regulations 28-16-57a through 63, 28-18-1 through 17, 28-18a-1 through 31 and 33, 28-16-150 through 154, 28-46-7, and the authority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been prepared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.
The proposed actions concerning the draft documents are based on staff review, applying the appropriate standards, regulations, and effluent limitations of the state of Kansas and the Environmental Protection Agency. The final action will result in a Federal National Pollutant Discharge Elimination System Authorization and/or a Kansas Water Pollution Control permit being issued, subject to certain conditions, revocation, and reissuance of the designated permit or termination of the designated permit.

The existing facility is a mechanical wastewater treatment plant consisting of: raw sewage pumps, mechanical bar screens (2), centrifugal grit removal (2), CMAS basins (2), anoxic basin, anaerobic basin, final clarifiers (2), aerobic digesters (4), UV effluent disinfection, gravity belt sludge thickening, belt filter press, and standby generator. The facility receives domestic wastewater from residential and commercial areas and industrial wastewater from local manufacturers. The proposed permit contains limits for biochemical oxygen demand, total suspended solids, pH, ammonia, E. coli, total nitrogen, total phosphorus, chlorides, and chronic whole effluent toxicity; as well as monitoring for nitrates + nitrites, total Kjeldahl nitrogen, total nitrogen, total phosphorus, and chlorides. Permittee has received a Consent Order Case Docket No. 22-E-002 BOW from KDHE. Permittee shall implement the requirements of the Consent Order and any amendments or replacements thereto. | ||

The proposed action is to issue a new State/NPDES permit for an existing facility, therefor an antidegradation study was not required. This is an existing, water treatment plant that removes iron and manganese from well water from two wells, using potassium permanganate. A chorine polymer is then added in a rapid mix basin. The water is then sent to a flocculation basin, where ammonia is added. Waste streams generated from this facility consists of wastes from a filter back wash (2,000 gpd) and a primary sedimentation basin. Wastes from pressure filters are then discharged to Stranger Creek. (Outfall 001A). The proposed permit contains limits for total residual chlorine, total suspended solids, and pH, as well as monitoring for flow. |

The proposed action is to reissue an existing pretreatment permit for an existing facility. This facility can process metal parts for various clients. This includes phosphating steel parts to prepare them for paint, using a three-stage washer. (Outfall 001A) A new automated zinc plating operation will also be utilized to treat steel and a new automated anodizing operation will be used to process aluminum parts. Spent wastewater from the new regulated processes will be treated by a new DMP treatment system to reduce and remove heavy metals, before discharge. If necessary, wastes from the three-stage washer can also be treated by the new treatment system, if needed. Domestic wastes and wastes generated from the reverse osmosis system are also directed to the city sanitary sewer but are not treated and are not regulated. The proposed permit contains limits for pH, Total toxic organics, cadmium, chromium, copper, lead, nickel, silver, zinc, and cyanide. |
Persons wishing to comment on or object to the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and Environment (KDHE) if they wish to have the comments or objections considered in the decision-making process. All written comments regarding the draft documents, application or registration notices received on or before January 28, 2023, will be considered in the formulation of the final determination regarding this public notice. Please refer to the appropriate Kansas document number (KS-AG-22-327/330, KS-Q-22-122/124, KS-PT-22-014) and name of the applicant/permittee when preparing comments.
All comments received will be responded to at the time the Secretary of Health and Environment issues a determination regarding final agency action on each draft document/application. If response to any draft document/application indicates significant public interest, a public hearing may be held in conformance with K.A.R. 28-16-61 (28-46-21 for UIC). A request for public hearing must be submitted in writing and shall state the nature of the issues proposed to be raised during the hearing.
