Public Notice

The Kansas Department of Health and Environment (KDHE) has drafted a Kansas Section 401 of the Clean Water Act (CWA) water quality certification requested by Union Pacific Railroad from the United States Army Corps of Engineers (USACE) per Public Notice No. NWK-2022-00587. The applicant proposes 3.4 miles of railroad improvements to increase transport capacity on the Medora to Inman Line; crossing the Little Arkansas River in Reno County. This involves placing fill material in waters of the U.S. for the construction of railroad siding track including a new track embankment and bridges/culverts resulting in permanent fill in four wetlands, totaling 1.44 acres, and 38 linear feet of stream channel, plus temporary fill in a wetland, totaling 0.03 acres, and two stream channels, totaling 60 liner feet.

The draft certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before October 20, 2022. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by November 20, 2022, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
