Public Notice

The Kansas Department of Health and Environment (KDHE) has drafted a Kansas Section 401 of the Clean Water Act (CWA) water quality certification as requested by KU Endowment, Lawrence, Kansas as documented in the United States Army Corps of Engineers (USACE) Public Notice No. NWK-2022-00290. The proposed project as stated by the applicant, is “to construct a mixed-use, innovation business park that serves as a western gateway to the University of Kansas.” The development of approximately 150 acres includes the construction of interior roadways, lots, utilities, storm water best management practices, and green space. Waters of the U.S. impacted include 5 wetlands totaling 0.94 acres and 358 feet (309 feet of general fill and 49 feet of pipe fill) of an unnamed tributary draining to Yankee Tank Creek.

The draft certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before July 28, 2022. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by August 28, 2022, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
