Notice Concerning Proposed Kansas Air Quality Construction Permit
Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality construction permit. Bartlett and Company, L.P. has applied for an air quality construction permit in accordance with the provisions of K.A.R. 28-19-300. Emissions of PM, PM10, PM2.5, VOC, SOx, NOx, CO, and HAPs were evaluated during the permit review process.
Bartlett and Company, L.P., 4900 Main St., Suite 1200, Kansas City, MO 64112, is proposing to construct and operate a new soybean processing plant and grain elevator to be located at Section 32, Township 32S, Range 17E, Cherryvale, Montgomery County, KS 64112.
A copy of the proposed permit, permit application, all supporting documentation, and all information relied upon during the permit application review process are available for public review from the date of publication during normal business hours at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366 and at the Southeast District Office, 308 W. 14th St., Chanute, KS 66720. To obtain or review the proposed permit and supporting documentation, contact Ashley Eichman, 785-296-1713, at the central office of the KDHE or Ryan Jack, 620-860-7235, at the Southeast District Office. The standard departmental cost will be assessed for any copies requested. The proposed permit, accompanied with supporting information, is available, free of charge, at the KDHE BOA Public Notice website at https://www.kdhe.ks.gov/413/Public-Notices.
Please direct written comments or questions regarding the proposed permit to Ashley Eichman, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366. In order to be considered in formulating a final permit decision, written comments must be received no later than 12:00 p.m. Monday, July 25, 2022.
A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Ashley Eichman, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than 12:00 p.m. Monday, July 25, 2022, for the Secretary of Health and Environment to consider the request.
If a request is received, a public hearing is tentatively scheduled at 1:00 p.m. Thursday, July 28, 2022, at th Cherryvale Public Library, 329 E. Main St., Cherryvale, KS 67335. If no requests to hold the public hearing are received by Monday, July 25, 2022, the public hearing will be cancelled. A notice of the cancellation will be posted at the KDHE website at https://www.kdhe.ks.gov/413/Public-Notices.
If a hearing is conducted, all interested parties will be given a reasonable opportunity to present their views orally or by submission of written materials during the hearing. In order to give all parties an opportunity to present their views, it may be necessary to limit oral presentations to a specific time limit. Any individual with a disability may request accommodation in order to participate in the public hearing and may request the proposed materials in an accessible format. Requests for accommodation must be made no later than Tuesday, July 12, 2022, by contacting the Bureau of Air at 785-291-3271.
