Notice of Permit Transfer of Municipal Solid Waste Landfill

The Kansas Department of Health and Environment (KDHE) received an application from the City of Sharon Springs, Kansas to transfer their municipal solid waste landfill to Wallace County. The landfill site is located at 1210 K-27 Hwy., Sharon Springs, KS 67764, approximately two miles south of Sharon Springs, Wallace County. The applicant proposes a transfer of the facility permitted area of 45.85 acres and disposal area of 25.95 acres from the City of Sharon Springs to the Wallace County government. Wallace County will assume responsibility and will be the sole owner of the municipal solid waste landfill. The landfill will continue to operate in conformance with state solid waste regulations and accept only municipal solid waste as defined by Kansas statutes.

The Wallace County Commissioners have certified that the application described herein is consistent with their solid waste management plan, local land use restrictions or zoning, and compatible with surrounding land use. KDHE has reviewed the application and found it to be in conformance with the state solid waste statutes and regulations.

KDHE is providing public notice of their intent to issue a permit to Wallace County to allow the transfer of this facility as described herein. However, a final decision to issue the permit has not been made, and KDHE will consider information gathered during the public comment period before making a final decision. A copy of the permit application, engineering drawings and draft permit with respect to this permit action will be available for public review at https://www.kdhe.ks.gov/676/Solid-Waste-Public-Notices from February 10, 2022 through March 14, 2022, during normal business hours at the following locations:

Additionally, the permit application form with primary application information is available for public viewing at https://www.kdhe.ks.gov/676/Solid-Waste-Public-Notices. Anyone wishing to comment on the proposed facility should submit a written statement by 5:00 p.m. March 14, 2022, to Kristofer Ho of KDHE at the address listed above, via facsimile to 785-296-2323, or via email to Kristofer.Ho@ks.gov. Comments that are postmarked by and received within one week thereafter will also be considered.

After consideration of all formal comments as described above, KDHE will make a final decision on whether to transfer the permit. Notice of the decision will be given to the applicant, anyone who submitted formal comments, and those who requested notice of the final permit decision.
